Terms of service
General Terms and Conditions of Delivery Customers
These 'General Terms and Conditions of Delivery for Customers' apply to the relationship between Tjins.nl and Tjins.online and the Customers. For catering services, we refer to the 'Uniform Conditions for the Catering Industry'.
Definitions
Offer: the product and service offerings of Tjins.nl and Tjins.online that can be ordered by the Customer via the Platform from Tjins.nl and Tjins.online.
Order: an order from the Customer via the Platform at Tjins.nl and Tjins.online of the Offer selected by the Customer.
Customer: a natural or legal person who places an Order via the Platform.
Agreement: an agreement between the Customer and Tjins.nl and Tjins.online with regard to a
Order and the delivery or collection of the Order.
Platform: the website(s), apps, tools and other devices of Tjins.nl and Tjins.online and its affiliates
companies and business partners to which the Service is made available.
Tjins.nl and Tjins.online: a company that prepares and sells meals, drinks and related items and uses the Platform for the conclusion and payment of Agreements.
Restaurant information: the information of the Restaurant regarding, among other things, company and contact details, general information, product range (meals, side dishes, options and drinks), prices for each individual product (including VAT), company logo, graphic material, delivery area ( including postcodes), delivery costs and minimum order amounts.
Service: the commercial services and/or activities provided by Tjins.nl and Tjins.online
offered to the Customer, including publishing the Offer, facilitating the conclusion of Agreements and forwarding Orders to Tjins.nl and Tjins.online.
Tjin's: Tjin's Exotic Sandwiches V.O.F. acting for itself and on behalf of any legal entity or person that directly or indirectly controls, is controlled by or falls under the common control of Tjin's Exotic Broodjes V.O.F.
3. Applicability
These General Terms and Conditions of Delivery for Customers only apply to the Service.
Tjin's is not responsible for the Offer. On the Offering are in addition, if
applicable, the uniform terms and conditions for the catering industry apply.
By placing an Order, the Customer immediately enters into an Agreement with Tjins.nl for the delivery of the Offer selected by the Customer. The Customer is bound by the Order and is not entitled to a refund, except in the event of cancellation by Tjins.nl pursuant to Article 6 below.
4. The Offering
1. Tjin's publishes the Offer on the Platform, typing errors may occur in the Offer.
Tjins.nl can use ingredients and additives for meals and drinks that can cause allergies and intolerances. If a Customer is allergic to certain foods, we recommend that you contact Tjins.nl by telephone for up-to-date allergen information before placing the order.
Tjin's displays all Restaurant information in such a way that it is clear to the Customer what
its rights and obligations are attached to the acceptance of the Offer.
Tjin's accepts no liability for the accessibility of the Platform.
5. The Agreement
The Agreement is concluded at the moment the Customer finalizes the Order by clicking on the 'Pay' button during the process of placing an Order via the Platform.
After receiving the Order, Tjin's will electronically confirm the Order to the Customer.
The Agreement can only be executed by Tjins.nl if the Customer provides correct and complete contact and address details when placing the Order.
The Customer is obliged to immediately report any inaccuracies in payment details provided or stated to Tjins or Tjins.nl.
In connection with information about the status of his Order, the Customer must be available for Tjin's.nl by telephone or e-mail (as indicated when placing the Order) after placing the Order.
If the Customer chooses delivery of the Order, he must be present at the
delivery address indicated by the Customer in order to receive the Order.
If the Customer chooses to collect the Order, he will serve at the chosen time
be present at the pick-up location of the Restaurant, which is specified in the confirmation email,
text message or on the website of Tjins.nl.
Upon delivery of the Order, Tjins.nl may ask for identification if the Order contains alcoholic products or other products with an age limit. If the Customer cannot identify himself adequately or does not meet the minimum age requirements, Tjins.nl will refuse the relevant
deliver products to the customer. In this case cancellation costs may be charged.
6. Dissolution of the Agreement and Cancellation of the Order
The Consumer can dissolve an Online Agreement with regard to the purchase of a Product without giving reasons within the cooling-off period of 14 days after entering into the purchase contract ("Right of Withdrawal").
2. In connection with the perishability of the Offer, the Customer has no right to dissolve the Agreement. Cancellation of the Order by the Customer with Tjin's is only possible if Tjin's explicitly indicates that Cancellation of the Order by the Customer is possible.
Tjin's has the right to cancel the Order if, for example, the Offer is not
is no longer available, the Customer has provided an incorrect or unreachable telephone number or other contact details or in case of force majeure.
If the Customer places a false Order (for example by providing incorrect contact details, not paying or not being present at the delivery location or collection location to receive the Order) or otherwise fails to fulfill its obligations under the Agreement , then Tjins.nl can decide to refuse future Orders from the relevant Customer.
Tjin's has the right to refuse Orders and cancel Agreements if there is reasonable doubt about the correctness or authenticity of the Order or the contact details. If Tjin's cancels an Order that has already been paid, Tjin's will transfer that amount to the same account from which the payment was made. If the Customer places apparently false or fraudulent Orders, Tjin's can report this to the police.
7. Payment
The moment the Agreement has been concluded in accordance with Article 5.1 of these General Terms and Conditions of Delivery for Customers, the Customer is obliged to pay Tjins.nl for the Order. The Customer can meet this payment obligation by paying with an online payment method via the Platform or by paying Tjins.nl at the door or at the pick-up location.
Subject to the provisions of Article 6.5 of these General Terms and Conditions of Delivery for Customers, the (partial) refund of an online payment is only possible if the Order cannot be delivered (in full). The reversal always takes place on the same account from which the payment was made.
8. Complaints procedure
Complaints from the Customer about the Offer, the Order or the performance of the Agreement must be submitted to Tjins.nl.
If the Customer has a complaint about the Service, the complaint must be communicated by e-mail or in writing by post to the customer service of
Tjins.nl at the Customers specified in Article 2 of these General Terms and Conditions of Delivery
contact address.
After the complaint has been received by Tjin's, Tjin's will respond as soon as possible, but no later than within a week, with a confirmation of receipt. Tjin's strives to handle the complaint as quickly as possible, but no later than within 2 weeks.
Complaints as described in paragraphs 1 and 2 of this article must be submitted within a reasonable time
after the Customer has discovered the defects, are fully and clearly described
submitted to Tjins.nl.
The European Commission manages an ODR platform. This platform can be found at
http://ec.europa.eu/odr. Tjins.nl excludes the use of Alternative Dispute Resolution as
referred to in Directive 2013/11/EU explicitly. The e-mail address of Tjins.nl is

9. Intellectual Property
All (copyright) rights to the Products, the recipes of the Products, all (copyright) rights to the Services, as well as all industrial rights to the trade name, brand names and logos of Tjin's, are vested exclusively in Tjin's.
The Buyer is not permitted to copy, change, resell or otherwise publish or put into circulation the Products or the recipes of the Products, subject to the restrictions set by law and unless of the nature of the delivered goods follows otherwise or has been expressly agreed otherwise in writing.

11. Newsletter
When completing the Order, the Customer can also choose to receive the
newsletter. The Customer can unsubscribe from this newsletter
by contacting customer service via the Customers address listed in Article 2 of these General Terms and Conditions of Delivery under 'Correspondence Address'
